Terms and Conditions

These Terms are an agreement between you and Oxpecker Technology Pvt. Ltd., which runs Helium (“Helium”, “we”, “us”), for your use of Agentcy, the product video app on this website (the “service”). By signing in, buying videos or otherwise using the service, you agree to these Terms and to our Privacy Policy. If you use the service for a business, you confirm you can bind that business, and “you” includes it.

The service

Agentcy makes short product videos with AI from what you give us: a product link, product photos, your store’s address, a video you want to copy and the choices you make in the app. Videos usually take 10 to 25 minutes. Features and output may change, and we don’t promise any particular sales, reach or ad results.

Your account

You sign in with your Indian mobile number and a one-time code we send on WhatsApp. You confirm you use that number and may receive WhatsApp messages on it. You’re responsible for activity on your account. Tell us at hello@gethelium.co if you think someone else has used it.

We send WhatsApp messages only for sign-in codes and to tell you a video is ready. We don’t share your number with anyone for their marketing.

Buying videos

  • Your first video is free. After that you buy videos in packs; prices are shown in the app before you pay and include GST.
  • Payments are processed by Razorpay. We don’t see or store your card or UPI details.
  • Each new video uses one video from your balance. Asking us to remake a video also uses one.
  • If a video fails to make, trying it again is free.
  • Refunds follow our Refund Policy.

What you give us and what you get

You keep your rights in the product links, photos, store data, brand material and videos you give us (“your content”). You let us use your content to make your videos and run and improve the service. You confirm you have the right to use it, including any trademarks and any person shown in it.

The videos we make for you are yours to use anywhere, including as ads. Check every video before you publish it, including for brand, legal and ad-platform rules. Videos made with AI may resemble videos made for others.

When you ask us to copy a video, we use it only as a reference for style and structure. Don’t ask us to reproduce someone else’s content in a way that infringes their rights.

Fair use

You agree not to:

  • break the law or anyone’s rights using the service;
  • upload content you don’t have the right to use, or make misleading or unlawful ads;
  • try to access other accounts, overload or interfere with the service, or reverse engineer it except where the law allows.

We may suspend accounts that do.

Disclaimers and liability

The service and videos are provided “as is”. To the extent the law allows, we disclaim implied warranties, and we aren’t liable for indirect or consequential losses such as lost profits or revenue. Our total liability for any claim is limited to what you paid us in the three months before it. You’ll cover our costs from claims caused by your content or your use of the videos.

Ending, changes and law

You can stop using Agentcy at any time. We may suspend or end access if you break these Terms, if the law requires it or if we close the service. We may update these Terms; the date at the top changes when we do, and using the service afterwards means you accept the update. These Terms are governed by the laws of India.
